The ODYSSEY MALTA experience located at the Upper Piazza at Mercury, Triq San Gorg, St. Julian’s – Malta and operated by Mercury Towers Ltd., J. Portelli Projects, 1400, Block 14, Portomaso, St. Julian’s – Malta, is mainly comprised of a multi-sensory exhibition and a flying theatre ride.
All persons visiting Odyssey Malta (the “Experience”) are subject to the following terms and conditions and by purchasing one or more tickets for the experience you confirm to Odyssey Malta that you accept these Terms of Use.
Health and Safety Considerations & Restrictions
1. The below listed special effects are used in the multi-sensory exhibition. Odyssey Malta does advise that if any guests have a pre-existing condition that could be exacerbated by exposure to any of the below mentioned special effects, then these guests should not enter the multi- sensory exhibition.
a. Smoke, Fog, Haze and Mist
b. Artificial Scents
c. Strobe Lighting
d. Loud and Sudden Sounds
2. As per our safety restrictions, guests should ride the flying theatre only if:
a. They are taller than one (1) meter and comfortably fit into the seat with the seat bar locked.
b. The upper legs of a passenger are long enough so that the passenger cannot slip out upwards from under the seat bar cushion or across the leg divider when the seat bar is closed.
c. They do not feel discomfort if they have short legs and my not be able to bend their knees as intended whilst seated with the seat bar locked.
d. They are strong enough to keep their head and torso steady and able to hold on to handles, lap bars or hand rails and brace against ride forces to avoid injury (e.g. whiplash injury).
e. As a person in need of a wheelchair one can leave the wheelchair (aided by their Assistant, if necessary) and must be able to support themself in the seat and keep their head and torso steady to avoid injury (e.g. whiplash injury).
f. They DO NOT suffer from:
I. Epilepsy
II. High blood pressure
III. Heart conditions
IV. Intoxication
V. Motion sickness
VI. Broken limbs
VII. Back or neck complaints
VIII. Acrophobia
IX. Thalassophobia
X. Aquaphobia
g. They are NOT pregnant or DO NOT have a pre-existing condition that could be exacerbated by exposure to special effects such as:
I. Smoke
II. Mist
III. Wind
IV. Artificial scents
V. Strobe lighting
VI. Sudden jarring movements
VII. Loud and sudden noises
h. They remove loose objects (such as but not limited to sarongs, flip flops, clogs, sun glasses, coins and mobile phones) from their person and leave them at a designated holding area.
3. Children up to the age of 14 must be accompanied by an adult to ride the flying theatre.
4. As per our safety restrictions, any items which the Odyssey Malta staff deem may pose a risk to the health and safety of the flying theatre ride users or that may cause damage to the flying theatre ride equipment shall not be permitted to go on Odyssey Malta’s flying theatre ride. A small designated holding area for these items will be provided by Odyssey Malta which however accepts no responsibility for the loss or theft of, or damage to, any personal items being kept in this holding area.
5. To prevent offensive weapons or dangerous articles from being taken into Odyssey Malta, guests are admitted on condition that if requested to do so, they will allow themselves and/or their belongings to be searched. It is prohibited to take to the experience any weapons, fireworks, smoke bombs, glass bottles, flammable liquids or other articles, which may cause injury.
6. Guests must remain within permitted guest areas and must adhere to our health and safety procedures and guidelines (as guests may be instructed to do so by Odyssey Malta staff from time to time).
7. Odyssey Malta reserves the right, to its absolute discretion, to refuse entry to or remove from the experience, the lobby/gift shop area and/or Mercury Towers any person who:
a. has behaved in a manner which, in the opinion of Odyssey Malta staff, is detrimental to the safety or enjoyment of other guests;
b. has used threatening, abusive or insulting language or behaviour or in any way provokes or has behaved in a manner that may provoke a breach of the peace;
c. is or appears to be under the influence of drugs or alcohol.
Other Restrictions
8. Photos, video recording, and sound recording of any elements of the experience are strictly prohibited.
9. Mobile phones must be kept on silent mode and phone calls are not to be made or taken throughout the experience.
10. Unnecessary noise (such as that issuing from the use of mobile phones, radio sets, personal stereos and other electrical equipment) or any behaviour likely to cause annoyance to other visitors, or disruption of any kind, is not permitted in Odyssey Malta and will result in immediate ejection from the experience. This applies equally to individuals and groups.
11. Any large purses, backpacks or other bags must be checked at the Odyssey Malta front desk as determined by Odyssey Malta’s sole discretion. Odyssey Malta however accepts no responsibility for the loss or theft of, or damage to, any personal items being kept at the front desk.
12. No food or beverages of any kind may be consumed within Odyssey Malta’s lobby/gift shop, dark walk exhibition and flying theatre ride.
13. Pets or animals of any nature are expressly prohibited at the experience (except for guide dogs and hearing dogs). Guide dogs or hearing dogs are not allowed on the Odyssey Malta flying theatre ride.
14. Smoking is strictly prohibited throughout the experience.
Cancellations, Refunds and Other Experience Ticket Terms & Conditions
15. It is recommended that a ticket holder checks-in at the Odyssey Malta front desk at least 5 minutes prior to the time one has booked for, however one must check-in not later than that booking time.
16. Tickets may be purchased either individually or in groups. Due to limitations of seating configurations on the flying theatre ride, it may not be possible for all members of a group to be seated together.
17. Tickets are sold for the experience (multi-sensory exhibition and flying theatre ride) as a whole. No refund or alternative price is offered for any reason in the case one does not partake in a part of the experience.
18. Tickets for the experience are non-refundable in case of no show or cancellation within 7 days from the day of the show booked. If you miss your pre-booked ticket time slot, Odyssey Malta will attempt without guarantee, to allow you to join the next available experience within the same day.
19. Cancellations prior to 7 days from the day of the show booked are subject to pay an administration fee of €5.00 per ticket. The remaining amount will be refunded by Bank Transfer. Bank Transfer Charges are payable by the refund claimant. The time it takes for the refunded amount to be made available again on the claimant’s bank account, varies from one bank to another as well as the country of origin of the bank, thus making this beyond Odyssey Malta’s control and responsibility.
20. All tickets expire and become null and void after the intended booking date.
21. Save as otherwise permitted by Odyssey Malta, all persons visiting the experience must pay for admission prior to being given access to the dark walk exhibition holding area. Tickets must be retained at all times and submitted for inspection if required by any staff member or agent of
Odyssey Malta. Any person attempting to gain admission without a ticket may be ejected from Odyssey Malta and/or Mercury Towers.
22. Re-sale of Odyssey Malta tickets is prohibited. If Odyssey Malta has reason to believe that a ticket has been resold, the holder may be refused entry to, or ejected from, the experience without compensation.
23. Odyssey Malta will expend reasonable efforts to ensure that the experience is open for use by visitors during normal opening hours. However, Odyssey Malta reserves the right, in its absolute discretion, whether for safety reasons or otherwise, and with or without prior notice, to close the experience. In the event of such closure, Odyssey Malta will provide a refund to any guests who have a ticket for the time of the unexpected closure but otherwise shall have no liability whatsoever, including no liability for travel expenses or any other out of pocket expenses, in respect of closure of part or all of the Odyssey Malta experience.
24. Viewing Platform access is offered subject to availability and at the discretion of the management. Should the Viewing Platform not be available on the day for whatever reason, no refund will be due.
Disclaimer of Liability and Other Miscellaneous Provisions
25. Odyssey Malta, its directors, employees or agents, shall not be liable for any loss or damage, direct or indirect, howsoever arising, including without limitation any distress, inconvenience or anxiety caused during the course of any ride undertaken and/or during evacuation from the experience in the event of breakdown or accident. Ticket holder voluntarily assumes all risks and dangers incidental to the Odyssey Malta experience, whether occurring prior to, during, or after the visit.
26. From time to time, Odyssey Malta or other authorized parties may carry out photography and/or video recording and/or other monitoring on or in the vicinity of Odyssey Malta, which may feature visitors. By accepting these terms and conditions, you agree that Odyssey Malta or any authorized party may use such images in perpetuity, in any promotional, advertising or publicity material in any format whatsoever. You further agree that copyright in these materials rests with Odyssey Malta or such authorized party (as the case may be).
27. This agreement will be governed by and interpreted in accordance with the laws of Malta, both parties submit to the exclusive jurisdiction of the courts of Malta for all actions and proceedings relating to or arising from this agreement.
